Terms of Service
Last updated October 12, 2026
The short version
Your brand and your files are yours. You give us only the rights we need to run Someones for you. Use it lawfully, only for brands you have the right to use, and don't abuse it. Someones is in an early beta, so it is provided as is. If we ever have a dispute, most can be settled by individual arbitration, with exceptions where your local law says otherwise. The full terms below are what count.
1. Who these terms are with
These Terms of Service (the "Terms") are an agreement between you and SOMEONES LLC, a Washington limited liability company ("Someones," "we," "us"). They cover the website at someon.es, the Someones app, its share links, emails and any related services (together, the "Service"). If you use the Service for a company or other organization, you accept these Terms for it, you confirm you have authority to do so, and "you" means that organization as well as you.
By joining the waitlist, creating an account, or using the Service, you agree to these Terms and confirm you have read our Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility
Someones is a professional tool. You must be at least 18, or the age of majority where you live, and able to form a binding contract. You may not use the Service if you are barred from doing so by law, including the sanctions laws in section 17.
3. Your account
- Keep your sign-in details secure and tell us right away if you think someone else has used them.
- You are responsible for what happens under your account and for the people you invite to your workspace.
- Workspace owners and admins control who can see and edit brands and files in their workspace, and can remove members. If your access comes through an organization, that organization may control your account.
- Give us accurate information and keep it up to date.
4. Your content
You own it. "Your Content" means everything you or your team put into the Service or make with it: brand kits, logos, typefaces you upload, colors, images, templates, slides, documents, social posts, charts, emails, comments and anything else. As between you and us, you keep all rights in Your Content.
The rights you give us. You grant Someones a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and adapt Your Content only as needed to provide, secure and support the Service for you, to follow your instructions (for example, when you share a link or send Your Content to an AI provider you chose), and to comply with law. This license ends when Your Content is deleted from the Service, except for copies in backups that are removed on their normal schedule and anything you shared with others before deletion. We do not sell Your Content, and we do not use it to train AI models.
Your promises. You confirm that you own Your Content or have every right, license and permission needed to use it in the Service and to grant the rights above, including rights to any trademarks, logos, typefaces, photographs and other material it contains. Font licenses matter here: only upload typefaces your license lets you use this way.
Sharing. When you create a share link, anyone with the link can view what it points to. You decide what to share and with whom, and you can turn a link off.
5. Reading brands from websites and files
When you give Someones a website address or a file, we read it to suggest colors, typefaces, logos and imagery for a brand kit. For a website, we fetch its public pages and may consult public sources about it. Use this only for brands you own, work for, or are otherwise authorized to represent. Suggestions are automated and may be incomplete or wrong; review them before you rely on them. Reading a brand gives you no rights in it: trademarks, logos and images remain the property of their owners.
6. AI features
- Your choice of provider. Some features use an AI provider you connect (such as Anthropic, OpenAI, Google or OpenRouter) with your own account and key. When you use them, the relevant content is sent to that provider, under its terms and privacy policy, which you are responsible for accepting. You can turn AI off.
- Output. As between you and us, what AI features produce for you is Your Content. AI can be wrong, incomplete or similar to content made for others. Review it before you use it, especially for legal, medical, financial or other high-stakes purposes.
- Costs and keys. Charges from your AI provider are yours. Keep your keys secure; you can remove them at any time.
7. Acceptable use
You agree not to, and not to let anyone else:
- break any law, or infringe or misappropriate anyone's intellectual property, privacy or other rights;
- impersonate a person or brand, or create misleading, fraudulent, phishing or deceptive material;
- upload or create content that is unlawful, defamatory, harassing, hateful, sexually exploits minors, or promotes violence;
- upload malware, or probe, scan, attack or test the vulnerability of the Service without our written permission;
- get around access controls, rate limits or usage limits, or access another customer's data;
- scrape, crawl or copy the Service, or use the brand reader to harvest data at scale or read sites you are not authorized to represent;
- overload or disrupt the Service, or use it in a way that harms other users or our providers;
- reverse engineer, decompile or copy the Service, except where the law allows it despite this limit;
- resell or sublicense the Service, or use it to build a competing product; or
- use the Service to send spam or unsolicited messages.
We may remove content or limit access to protect the Service, our users or the public, or to comply with law. Where reasonable, we'll tell you why.
8. Copyright and takedown notices
We respect intellectual property rights and respond to notices of infringement, including under the US Digital Millennium Copyright Act and the EU Digital Services Act. To report content, email someone@someon.es with: your contact details; the work you believe is infringed; where the material is (a link); a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your signature. If your content is removed, you may send a counter-notice with the same details and your consent to jurisdiction. We may close the accounts of repeat infringers.
9. Our rights
The Service, including its software, design, templates we provide, and the Someones name and marks, belongs to us and our licensors and is protected by law. We give you a limited, non-exclusive, non-transferable, revocable right to use the Service under these Terms. Templates and starter content we provide may be used in your work made with the Service. If you send us ideas or feedback, we may use them freely with no obligation to you.
10. Beta, changes and availability
Someones is in alpha and beta testing. Features may change, break, or be removed, and we may limit or end access to the beta. Keep your own copies of important work: export what matters to you. We may update the Service at any time. We aim to keep it available but don't promise it will be uninterrupted or error-free.
11. Fees
The Service is free during the beta. If we introduce paid plans, we'll tell you the price and terms before you are charged, and nothing will be charged without your agreement. Paid plans may come with additional terms, which will be shown to you before you buy. Prices exclude taxes unless stated.
12. Privacy and data protection
Our Privacy Policy explains how we handle personal information. Where we process personal data in Your Content on your behalf, we act as your processor (service provider) and you are the controller (business). You are responsible for having a lawful basis and giving any notices needed for personal data you put into the Service. Business customers who need a data processing agreement, including the EU Standard Contractual Clauses or the UK Addendum for international transfers, can request one at someone@someon.es.
13. Suspension and ending
You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or if your use creates risk for us or others; where practical, we'll give notice first. We may also end the beta or the Service with reasonable notice. After your account ends we will delete Your Content within a reasonable time, apart from what we must keep by law. Sections that by their nature should survive (including 4, 9, and 14 to 18) survive.
14. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don't warrant that brand suggestions or AI output are accurate, or that the Service will meet your needs. Some places do not allow these exclusions, so some may not apply to you.
15. Limitation of liability
To the fullest extent the law allows: (a) neither Someones nor its suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data, even if advised they were possible; and (b) our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or US $100.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct where the law does not allow it to be limited.
16. Indemnity
If you use the Service for an organization, that organization will defend and indemnify Someones and its people against third-party claims, and related losses and reasonable costs, arising from Your Content, your use of the Service in breach of these Terms, or your breach of law or of anyone's rights. We will tell you promptly about a claim and let you control its defense, though you may not settle it in a way that admits fault for us without our consent.
17. Export controls and sanctions
You will comply with all export control and sanctions laws that apply to you and to the Service, including those of the United States, the European Union and the United Kingdom. You confirm you are not located in, or owned or controlled by anyone in, a country or region subject to comprehensive sanctions, and that you are not on any restricted-party list.
18. Disputes, governing law and arbitration
Talk to us first. Most problems can be solved quickly. Before starting any formal claim, email someone@someon.es with a description of the issue and what you want, and give us 60 days to try to resolve it informally.
Governing law. These Terms are governed by the laws of the State of Washington, USA, and applicable US federal law, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Binding individual arbitration. Except as stated below, any dispute arising from or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (or, for an individual consumer, its Consumer Arbitration Rules), before a single arbitrator. The seat will be in the State of Washington, and hearings will be held by video unless the arbitrator decides otherwise. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.
No class actions. You and Someones may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone but the individual party. If this waiver is found unenforceable for a claim, that claim (and only that claim) will go to court, not arbitration.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may ask a court for an injunction to protect its intellectual property or to stop misuse of the Service. Claims that must be heard in court will be brought exclusively in the state or federal courts located in the State of Washington, and both parties consent to their jurisdiction.
Opting out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing someone@someon.es with your name, the email on your account, and a clear statement that you opt out. Opting out does not affect the rest of these Terms.
If you live outside the United States. If you are a consumer in the European Union, the EEA, the United Kingdom, Switzerland, Australia, or any other place whose law does not allow these arbitration, class-waiver or governing-law terms to apply to you, they don't. You keep the protection of the mandatory laws of the country where you live and may bring proceedings in its courts. EU consumers may also use the European Commission's online dispute resolution information. Business customers outside the United States agree to arbitration as above, or, where arbitration is not permitted, to the courts located in the State of Washington.
Time limit. To the extent the law allows, any claim must be brought within one year after it arises, or it is barred.
19. Changes to these terms
We may update these Terms. We'll change the date above, and for material changes we'll give at least 30 days' notice by email or in the Service before they take effect, unless a change is required sooner by law or addresses a new feature. If you keep using the Service after changes take effect, you accept them. If you don't agree, stop using the Service. Changes to section 18 do not apply to disputes already notified to us.
20. General
- Entire agreement. These Terms, with the Privacy Policy and any order or plan terms you accept, are the whole agreement between us about the Service.
- Severability. If any part is found unenforceable, it will be enforced as far as possible and the rest stays in effect.
- No waiver. Not enforcing a right now does not give it up.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, with notice to you.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Independent parties. Nothing here creates a partnership, employment or agency relationship.
- Notices. We may send notices to the email on your account or show them in the Service. You can send notices to someone@someon.es. You agree to receive communications electronically.
- Language. These Terms are written in English. If we provide a translation, the English version controls to the extent the law allows.
- California users. Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
